Penalty Notice Information
The Academy currently use the expected sanctions which include Penalty Notice Fines for Unauthorised Leave of Absence Requests and Prosecutions under Section 444 (1) of the Education Act 1996. Penalty Notices are issued by the Local Authority and the Academy DOES NOT gain any financial reward for using them; fines are issued, processed and paid to the Local Authority. They are issued per parent/carer, per child and are £60 if paid within 21 days and £120 if paid between 21 and 28 days from issue; failure to pay results in the Local Authority taking further action in the Magistrates’ Court.
From September 2014 the Academy commenced the additional use of Penalty Notice Fines for students who have accrued 10 sessions (5 days) or more of unauthorised absence. Please be aware this includes late sessions coded as ‘U’ (arrival after 9.00am). Initially this intervention will be used for targeted groups of students e.g. Year 11 and exam groups. However, this may be extended to individuals with poor attendance as required.
From September 2015 the above number of sessions has been reduced by the Government from 10 sessions (5 days) to 8 sessions (4 days) of absence (within an 8 week period) before a Penalty Notice can be issued. Therefore please be aware that if your child has 8 unauthorised sessions (this includes late after the register has closed (9am)) of absence, you may receive a warning of a fine being issued.
Also, a reminder that Penalty Notices are also used for term time absence requests of 10 sessions (5 days) or more that have been unauthorised as well as the absence that has not been requested, as above.
The academy always wish to prevent Penalty Notices being issued by working with families to reduce absence levels however, we have a duty to enforce the law as above when necessary to secure your child’s right to their education. We hope that by raising your awareness you will do your best to avoid the above being necessary.
